A Pine Bluff man was shot and a second arrested after an incident Friday night in the area of Rhinehart Road and Pullen Street.


Dave M. Winston, 34, was shot in the leg and was taken to Jefferson Regional Medical Center after he flagged down a private vehicle, Detective Larry Gailey said in a probable cause affidavit presented in court Tuesday.


Police arrested Earnest Moore, 26, who allegedly said he shot Winston, but told police Winston had "tried to pick a fight with him earlier" and "acted like he was going to get a gun out of his pocket."


Officer Jason Boykin said in the initial police report he was loading gear into his police vehicle at about 6:10 p.m. Friday when he heard two gunshots, then heard two more before police dispatchers put out a call about a man being shot.


Boykins said in the report he responded to the area and a man later identified as Moore came out of a business and said: "Officer, I discharged my firearm. I had no choice."


Police located a handgun in Moore’s right front pocket, and according to the report, the gun contained one round in the chamber and one in the magazine.


Following a court hearing Tuesday, Jefferson County District Judge Kim Bridgforth set a $15,000 bond for Moore after ruling prosecutors had probable cause to charge him with first-degree battery.


Moore was also ordered to have no contact with Winston until the case is settled.
